Considerations

In addition to meeting the requirements of the EYFS and all the statutory legislation, detailed previously, consideration should be given to:

If employing staff then consideration needs to be given to recruitment, references, DBS checks, induction, training as well as all the legislation around employment https://www.gov.uk/browse/employing-people/contracts.

While an individual may be self-employed for tax purposes, if they are deemed to be a worker, they will be legally entitled to rights such as the national minimum wage, paid holidays, rest breaks, auto-enrolment pension, maximum working time and protection against discrimination. Please note that the local authority do not offer any pre-registration visits or financial support to start up childcare businesses.
